1. Affidavit of service filed by the petitioner be kept kith the record.
2. The writ petition
has been preferred praying for setting aside of the notification dated 03.08.2023 as served upon the petitioners by the handling transport contractor, Food transport contractor Food Storage Depot, Chharrah, Food Corporation of India , District –Purulia.
3. It is stated that petitioners representation filed before the authorities has not been considered till date.
4. At the time of hearing, learned counsel for the respondent no. 1 to

4 has raised the issue of maintainability.
5. It is submitted that the dispute in the present case is a labour dispute and the petitioner has an alternative forum where he can raise such dispute and without raising any industrial dispute, the petitioners cannot
approach this Court regarding any decision taken by the respondents by way of filing a writ application directly.
6. On hearing the learned counsels for the parties and on perusal of the materials on record, the writ application is disposed of with the direction that the respondent no. 3 herein
being the Divisional Manager, FCI, Purulia
shall consider the petitioners representation dated 14.9.2023 within 30 days from the date of communication of this order, on hearing the parties and by passing a reasoned order in accordance with law.
7. It is made clear that this Court has not gone into the merits of the case and none of the statements made in the writ application is admitted by

the respondents as no affidavits have been called for.
8. WPA 24979 of 2023 stands disposed of.
9. Urgent Photostat certified copy of this order, if applied for, be given to the learned counsel for the parties on usual undertakings.
