Learned counsel for the petitioner submits that the petitioner is in custody in connection with Bhawnathpur P.S. Case No. 48/2026 for the offence registered under Sections 64(2)(m), 351(2)(3) of BNS, now said to have been pending in the court of learned Judicial Magistrate 1st Class, Nagar Untari. 2. Learned counsel for the petitioner submits that though there is direct allegation against the petitioner in the FIR, but the charge-sheet has not been submitted on 31.05.2026. The petitioner is in custody since 16.05.2026 and there is no need for any custodial interrogation and there is no change of tampering with the evidence, therefore, the petitioner may be enlarged on bail. 3. Learned counsel for the State, while opposing the prayer for bail, has submitted that there is direct allegation against the petitioner, who is a person performing religious practices and has committed rape upon the victim and also stated the victim that if she would not co-operate, she would be turned mentally unsound. The petitioner may not be enlarged on bail as the victim has not yet been examined before the learned court. 4. After hearing the learned counsel for the parties and considering the direct allegation made against the petitioner and the fact that the victim is 2026:JHHC:26482 2 yet to be examined before the learned court, this Court is not inclined to enlarge the petitioner on bail.
