( 2026:JHHC:26411 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 8127 of 2026 ------ Prakash Mandal, aged about 44 years, son of Fulchand Mandal, resident of Ray Talab Road, Panduyatand, P.O. & P.S.-Sariya, Dist.-Giridih, Jharkhand … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. R.S. Mazumdar, Sr. Advocate : Mrs. Jasvindar Mazumdar, Advocate For the State : Mr. Pankaj Kr. Mishra, Addl. P.P. For the Informant : Mr. Anil Kr. Sinha, Advocate : Mr. Vishnu Kumar, Advocate ------ Order No.02 Dated- 02.09.2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Saria P.S. Case No.97 of 2026 registered for the offences punishable under sections 61/103(1)/238/3(5) of the B.N.S., 2023. The learned Senior Advocate appearing for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed the murder of Ashok Mandal and threw his dead body in order to screen himself and the co-accused persons of the offence. It is further submitted that the allegations against the petitioner are all false and the petitioner has been implicated in this case only on the basis of suspicion as he was having land dispute with the deceased and his family members. It is then submitted that the land dispute is a double edged weapon and the same can be used also to falsely implicate a person to settle scores. It is further submitted that the house of the deceased and the petitioner is situated in the same lane so the location of the mobile of the petitioner near the dead body is irrelevant in the facts of this case. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.11 of the bail application. It is then submitted that the petitioner has been in custody since 30.06.2026, as has been mentioned in paragraph no. 10 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. and the learned counsel for the informant opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Giridih, in connection with Saria P.S. Case No.97 of 2026 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
