Heard Mr. Sudhanshu Shekhar Choudhary, the learned counsel for the petitioner and the learned Spl.P.P.
In this application, the petitioner has prayed for quashing of the orders dated 29.07.2026 and 12.08.2026, passed in connection with Rajmahal P.S. Case No. 229/2026, by the learned SDJM, Rajmahal, whereby and whereunder, non-bailable warrant of arrest and proclamation under section 84 of BNSS have been issued.
Submission has been advanced by the learned counsel for the petitioner primarily focusing on the order dated 12.08.2026 that the same does not contain justifiable reasons and has merely taken note of the application submitted by the Investigating Officer for issuance of proclamation under section 84 of BNSS.
Learned Spl.P.P. has opposed the prayer made in this application.
The impugned order dated 12.08.2026 does indicate that no subjective satisfaction has been recorded by the learned SDJM, Rajmahal while issuing proclamation under section 84 of BNSS and consequently, the same is hereby quashed and set aside.
This application stands allowed to the extent mentioned hereinabove.
