Accused No.4 in Crime No.104/2026 registered by Byatarayanapura Police Station, Bengaluru, for the offences punishable under Sections 111(2)(b), 109, 352, 351(2), 351(3) and 190 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.104/2026 was registered by Byatarayanapura Police Station, Bengaluru, for the offences punishable under Sections 109, 352, 351(2), 351(3) and 190 of BNS, 2023 against Kiran @ Konga and others based on the first information dated 24.03.2026 received from Yeshwanth, who is the injured victim in the present case. Petitioner, who is arrayed as accused No.4 in the FIR was arrested on 28.03.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.3352/2026 was rejected on 16.04.2026. Learned counsel for the petitioner submits that petitioner is a youngster, aged about 19 years, having no criminal antecedents. Investigation of the case is now completed and charge sheet has been filed. The allegation of assaulting injured victim with knife is only as against accused Nos.1 and 2. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition, submits that injured victim has suffered grievous injuries in the incident in question and accused Nos.1 and 2 are persons with criminal antecedents. Accordingly, he prays to dismiss the petition. 6. In the first information submitted by the injured victim, he has stated that on 24.03.2026, he and his friends Chethan @ Katre and Srujan were sleeping on the terrace of the house of Chethan at Maruthinagar within the jurisdiction of Byatarayanapura Police Station, Bengaluru. At about 03.00 a.m., he suddenly heard his friend Chethan shouting and when he woke up, he saw the accused persons who had ill-will against Chethan. When the accused persons tried to assault Chethan @ Katre and Srujan, they allegedly managed to - 4 - HC-KAR NC: 2026:KHC:32434 CRL.P No. 7345 of 2026 escape and thereafter the accused persons caught hold of the victim and allegedly assaulted him with a knife and caused grievous injuries. The allegation of assaulting the victim with a knife is principally found in the first information as against accused No.1. It is also mentioned that after accused No.1 assaulted the victim with a knife, accused No.2 snatched the same knife and assaulted the victim. 7. Injured victim has suffered totally seven injuries in the incident and out of the same, two injuries which are incised wounds are certified as grievous injuries. The victim, who was treated in the Hospital was subsequently discharged and his condition is said to be stable. Petitioner aged 19 years has no other criminal antecedents. His continued detention in jail amongst hard core criminals may have an adverse impact on his mindset. Investigation of the case is completed and charge sheet has been filed. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 8. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.104/2026 registered by - 5 - HC-KAR NC: 2026:KHC:32434 CRL.P No. 7345 of 2026 Byatarayanapura Police Station, Bengaluru, for the offences punishable under Sections 111(2)(b), 109, 352, 351(2), 351(3) and 190 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
