CRL OP No. 10943 of 2026 __________ Page2 of 5 ORDER The petitioner, who was arrested and remanded to judicial custody on 16.04.2025 for the offences punishable under Sections 296(b), 74, 75 of BNS and Section 4 of the TNPHW Act in Crime No.38 of 2026 on the file of respondent police. 2.The allegation against the petitioner is that there was some domestic dispute, the petitioner who is the brother-in-law of the de-facto complainant, picked up a quarrel with her and abused her in filthy language. During the course of altercation, the petitioner had allegedly used criminal force, pulled and hugged the de-facto complainant with intent to outrage her modesty and further assaulted her, thereby causing intimation and disturbance. 3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person, he has been falsely implicated in this case and the petitioner has not committed any offences as alleged by the prosecution. He further submitted that the petitioner was arrested and remanded to judicial custody on
16.04.2026. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prayed for grant of bail to the petitioner. https://www.mhc.tn.gov.in/judis

Mr.V.J.Priyadarsana, learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that it is serious in nature involving outraging of modesty of women and he strongly opposed to release the accused on bail. 5.On perusal of the order dated 22.04.2026 passed by the Court below, it is seen that the petitioner in an intoxicated condition, misbehaved with the de- facto complainant in a public place, thereby, outraging her modesty, considering the facts and circumstances of the case, grave in nature of offence committed by the petitioner.
