By way of filing the instant criminal misc. petition, a challenge has been led to the impugned FIR No.34/2018, [2026:RJ-JP:16504] (2 of 3) [CRLMP-2585/2018] registered at Police Station Mahila Thana District Bharatpur for the offences punishable under Sections 498 A, 406, 323 and 354 IPC. 2. Learned counsel for the petitioners submits that a fabricated FIR based on false accusations and allegations has been lodged against the petitioners and the complainant has been residing separately, outside her matrimonial home since 30.05.2014. Learned counsel submits that several cases have been lodged by the parties against each other, but in fact no such incident, as alleged in the impugned FIR, has been caused by the petitioners and the same has been lodged by the complainant against all the family members to pressurize, harass and humiliate them. Hence, interference of this Court is warranted. 3. Per contra, learned Public Prosecutor as well as learned counsel appearing for the complainant opposed the arguments raised by learned counsel for the petitioners and submitted that after thorough investigation in the matter, the Police has found prima facie case against the petitioner No.1- Ramveer and petitioner No.3-Pooran Singh and involvement of the rest of the petitioners have not been found to be proved. Learned counsel submits that despite the above finding, the charge-sheet could not be submitted on account of operation of the interim order in favour of the petitioners since May, 2018. Learned counsel submits that, under these circumstances, interference of this Court is not warranted and the instant criminal misc. petition is liable to be rejected. 4. Heard and considered the submissions made at the Bar and perused the material available on the record. [2026:RJ-JP:16504] (3 of 3) [CRLMP-2585/2018] 5. The allegations levelled in the impugned FIR reveal commission of cognizable offence. The correctness of the allegations cannot be examined or adjudged by this Court while exercising its inherent jurisdiction under Section 482 Cr.P.C. Certainly, this task has been assigned to the Investigating Officer, who has thoroughly investigated the matter from all the four corners and has found the involvement of the petitioner No.1- Ramveer and petitioner No.3-Pooran Singh and involvement of rest of the petitioners i.e. petitioner Nos.2, 4, 5, 6 & 7 has not been found. However, the charge-sheet could not be submitted against the petitioner Nos.1 & 3 on account of the interim order dated 10.05.2018 passed by the co-ordinate Bench of this Court. 6. In the considered opinion of this Court, the petitioners are at liberty to take all the grounds and all available defences, which have been taken before this Court, at the appropriate stage of the trial before the Trial Court. 7. With the aforesaid observations, the instant criminal misc. petition stands disposed of. The interim order dated 10.05.2018 passed by this Court stands vacated. 8. Stay application as well as all pending applications, if any, stand disposed of. 9.
