JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition under Section 483(3) of BNSS 2023 is filed by the State with a prayer to cancel the regular bail granted to the respondents herein, in Crime No.508 of 2024 by the Court of 1st Additional District and Sessions - 3 - HC-KAR NC: 2026:KHC:31960 CRL.P No. 13393 of 2025 Judge, Davangere in Crl.Misc.No.307 of 2025 vide order dated 04.04.2025. 2. Heard the learned HCGP on behalf of the Petitioner-State. 3. FIR in Crime No.508 of 2024 was registered by Channagiri Police Station in Davanagere for offences punishable under Sections 103(1), 238, 3(5) of BNSS, 2023 against respondents herein and another, based on the first information dated 23.11.2024 received from Smt. Doddamma, niece of deceased Siddalingappa. In the said case, respondents herein were arrested and remanded to judicial custody. After completing investigation, charge- sheet has been filed in the said case against the respondents and others. Bail application filed by the respondents herein before the Trial Court in Crl.Misc.307 of 2025 was allowed on 04.04.2025. Perusal of the material on record would go to show that the entire case of the prosecution is based on circumstantial evidence. Undisputedly, the respondents herein do not have any criminal antecedents. During the course of investigation, the respondents were arrested and charge-sheet has been filed as against the respondents and others. It appears that, family of the deceased and the accused persons have a long-standing civil dispute with regard to certain immovable property and allegation against the accused persons is that, in the background of the said civil dispute, accused No.1 allegedly had contacted accused Nos.2 and 3 and had given supari to them to commit the murder of the said accused. The learned Sessions Judge, having appreciated the material collected as against the accused persons and also taking into consideration that the case of the prosecution is entirely depending upon circumstantial evidence, by a reasoned order has granted regular bail to the respondents herein who are arraigned as accused Nos. 1 - 5 - HC-KAR NC: 2026:KHC:31960 CRL.P No. 13393 of 2025 to 3 in Crime No.508 of 2024. It is not in dispute that the respondents have not violated any of the bail conditions imposed by the learned Sessions Judge, while granting regular bail to them.
