The limited grievance of the petitioner in the present writ petition is that though the petitioner was suspended in contemplation of enquiry, the authority has not granted any Subsistence Allowance in terms of Rule 53 of the Rajasthan Service Rules, 1951 (hereinafter referred as the ‘Rules of 1951’). 2. The Rule 53 of the Rules of 1951 deals with the grant of Subsistence Allowance and the respondents have not granted any Subsistence Allowance. They are duty bound to [2026:RJ-JP:17414] (2 of 2) [CW-7014/2026] grant Subsistence Allowance as is allowed under Rule 53 of the Rules of 1951. 3. Therefore, the present writ petition is disposed of directing the respondents to pass an order for grant of Subsistence Allowance to the petitioner within a period of 15 days from the date of receipt of a copy of this order. 4. A liberty is also given to the petitioner to make a representation to the respondents to consider his request for changing of the headquarter from Jaipur to Jodhpur, if any such request is made, the respondents are directed to sympathetically consider such representation and pass appropriate orders. 5.
