NATARAJ ORAL ORDER The petitioner has sought for a direction to respondent No.3 to consider his representation dated 12.02.2026 for allotment of marginal land situated on the southern side of Site No. 442, Sarakki 5th Phase Layout, Bengaluru. 2. The petitioner claims that he is the present owner of Site No.442 at Sarakki 5th Phase Layout, Bengaluru. His father, who was the allottee had submitted a representation to the respondent - BDA seeking allotment of marginal land. Later, he gifted the Site No.442 to the petitioner on 21.09.2015 and expired on 28.06.2017. The petitioner then filed a representation dated 25.07.2025 seeking for allotment of marginal land situated on the southern side of Site No.442. The - 3 - HC-KAR NC: 2026:KHC:30197 WP No. 15301 of 2026 petitioner was informed by the respondent - BDA on 03.02.2026 to furnish all the documents pertaining to Site No.442. The petitioner claimed that he submitted all the relevant documents along with the representation dated 12.02.2026. However, the respondent - BDA has not taken any steps to consider the representation of the petitioner. Petitioner claims that some third parties are also trying to get the marginal land allotted in their favour without considering his claim. The petitioner is therefore before this Court seeking for a direction to the respondent - BDA to consider the representation and allot the marginal land. 3. The learned counsel for the petitioner reiterated the above contentions. 4. The learned counsel for the respondents after securing instructions submitted that the petitioner had filed his application seeking allotment of marginal land on 25.07.2025 and a notice was issued to the petitioner on 03.02.2026 to furnish the documents. He contends that though the petitioner had submitted another representation dated 12.02.2026, no documents were enclosed along with the representation and - 4 - HC-KAR NC: 2026:KHC:30197 WP No. 15301 of 2026 therefore, the respondent - BDA was handicapped to consider the request of the petitioner for allotment of the marginal land. He therefore, submits that if the petitioner furnishes all documents, the respondent Nos.2 and 3 shall consider the same in accordance with law. 5. I have considered the submissions of the learned counsel for the petitioner as well as the learned counsel for the respondents. 6. The petitioner had filed a representation seeking allotment of the marginal land lying on the southern side of his property. This representation was filed on 25.07.2025. The respondent - BDA has acted on the representation after nearly seven months from the date of filing the representation by calling upon the petitioner to produce documents in support of the claim that he is the owner of Site No.442. Though the petitioner claims that all documents were furnished along with the representation dated 12.02.2026, the respondent - BDA claims to the contrary and submits that no documents were furnished. - 5 - HC-KAR NC: 2026:KHC:30197 WP No. 15301 of 2026 7. In view of the aforesaid, it is suffice to direct the petitioner to furnish all documents of title in respect of Site No.442 and it is appropriate to direct the respondent Nos.2 and 3 to consider the representation of the petitioner dated 12.02.2026 along with the documents that may be furnished by the petitioner pursuant to the order passed by this Court. 8. In view of the aforesaid, this petition is allowed. The respondent Nos.2 and 3 are directed to consider the representation of the petitioner dated 12.02.2026. The petitioner shall furnish a full set of documents of title in respect of Site No.442, Sarakki 5th Phase Layout, Bengaluru, within a period of ten days from the date of receipt of a certified copy of this Order. The respondent Nos.2 and 3 shall consider the representation of the petitioner within a period of two months from the date of the petitioner furnishing all the documents of title in respect of Site No.442.
