This revisional application is directed against an order dated November 18, 2025 passed by the learned Additional District Judge, 4th Court at Paschim Medinipore whereby the matrimonial suit filed by the petitioner being MAT Suit No. 88 of 2022 before the learned Additional District and Sessions Judge, 4th Court, Paschim Medinipore (In- charge) has been stayed till disposal of J. Misc. Case No.8 of 2025. 2. Mr. Bhattacharyya, learned Advocate appearing for the petitioner fairly submits that although, a challenge has been thrown to the order dated November 18, 2025, since the suit itself could not have been stayed unless an order directing payment of alimony had been passed and unless such order had been violated by the husband yet, in order to cut short the time that may be consumed in serving the opposite party and hearing of this petition after notice, he is restricting 2 his prayer to the extent of seeking a direction for expeditious disposal of the misc. case itself and the matrimonial suit. 3. Since a prayer for expeditious disposal of the misc. case is being made which would not affect the opposite party adversely, no direction for prior service of notice with a copy of the revisional application is being made. However, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order on the opposite party within a week from date. 4. Having heard Mr. Bhattacharyya, learned Advocate appearing for the petitioner and having considered the material-on-record, this revisional application is disposed of by requesting the learned Additional District Judge, 4th Court, Paschim Medinipore to dispose of J. Misc. Case No.8 of 2025 as expeditiously as possible and preferably within a period of two months from the next date fixed. 5. After the disposal of the misc. case i.e. J. Misc. Case No. 8 of 2025, the learned Additional District Judge, 4th Court, Paschim Medinipore is requested to dispose of MAT Suit No. 88 of 2022 as expeditiously as possible and preferably within a period of one year from the date of disposal of the said misc. case. It is however clarified that in case any order for payment of alimony pendente lite is 3 passed in the said misc. case, and the same remains uncomplied with, the MAT Suit would have to be stayed for non-compliance. 6. The order dated November 18, 2025 is not interfered with. C.O. 1632 of 2026 stands disposed of. There shall be no order as to costs. 7. The petitioner shall have liberty to communicate a gist of this order to the learned Advocate representing the petitioner before the learned Trial Court. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
