Case No. 223 of 2026 dated 23.04.2026 under Sections 109(1) / 115(2) / 117(2) / 126(2) / 171(1) / 171(2)(a) / 3(5) / 324(4) / 351(2) of the BNS, 2023. And In the matter of: Tanjilur Rahaman @ Tanjurul Mia & Anr. ….Petitioners. Mr. Asim Kumar Chakraborti …for the petitioners. Ms. Shalini Bairagi ….for the State. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case due to political reasons. The petitioners, who were political activists, were protesting on the particular day. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. She refers to the FIR itself, where there is a clear allegation made that the assailants came with arms, including firearms. She also refers to the statements of other witnesses, the photographs containing pictures of the two present petitioners and relies on the statement of a Constable. According to such statement, the petitioners not only attacked and assaulted the victim after surrounding him, but also tried to snatch away the official arms carried by the said Constable. There are pictures of the petitioners available in the case diary trying to assault the principal victim. 2 Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
