JUSTICE S VISHWAJITH SHETTY ORAL ORDER Petitioner who is apprehending arrest in Crime No.56/2023 registered by Siddapura Police Station, Bengaluru City for the offences punishable under Section 406, 420, 149 of - 3 - HC-KAR NC: 2026:KHC:32236 CRL.P No. 3310 of 2026 IPC is before this Court, in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.56/2023 was registered by Siddapura Police Station, Bengaluru City for the aforesaid offences against the Saraswathi and others, based on the first information dated 18.03.2023 received from Smt.Suryakalavathi K.N. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.932/2026 before the jurisdictional Sessions Court, which was rejected on 09.02.2026. Therefore, he is before the Court. 4. Learned counsel for the petitioner submits that petitioner is a practicing advocate and his name is not found in the FIR. He submits that several other criminal cases were registered with similar allegations and even in the said cases petitioner's name was not found in the FIR and he has been granted anticipatory bail in the said cases by this Court as well as by the jurisdictional Sessions Court. Petitioner has been cooperating with the police in the cases where he has been granted anticipatory bail. He is ready and willing to co-operate - 4 - HC-KAR NC: 2026:KHC:32236 CRL.P No. 3310 of 2026 even in the present case with the police for the purpose of investigation. Accordingly, he sought to allow the petition. 5. Per contra, learned HCGP who has opposed the petition, however, does not dispute the submissions made by the learned counsel for the petitioner. 6. Perusal of the first information submitted by Smt.Suryakalavathi K.N., would go to show that allegation is made against the accused who are named in the FIR that they had cheated the first informant with a promise to provide her a loan from Karnataka Government's Bhovi Development Corporation. Undisputedly, petitioner's name is not found in the FIR. It appears that similar complaints were filed even in other police stations in Bengaluru. One such case was registered in Crime No.7/2023 before the Doddaballapura Town Police Station, Bengaluru District and in the said case this Court has granted anticipatory bail to the petitioner in Crl.P.No.11850/2025 disposed of on 10.11.2025 and the Principal City Civil and Sessions Judge, Bengaluru has granted anticipatory bail to the petitioner in Crl.Misc.No.4505/2025 in a - 5 - HC-KAR NC: 2026:KHC:32236 CRL.P No. 3310 of 2026 case registered by the Directorate of Enforcement, invoking the provisions of Prevention of Money Laundering Act. 7. Learned HCGP has not disputed that the petitioner has complied with the bail conditions and he has been co-operating with the police for the purpose of investigation in the cases where he has been granted anticipatory bail. 8. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following : 9. The criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.56/2023 registered by Siddapura Police Station, Bengaluru City for the offences punishable under Section 406, 420, 149 of IPC, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond - 6 - HC-KAR NC: 2026:KHC:32236 CRL.P No. 3310 of 2026 for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
