For Petitioner(s): Mr.D.Balaji For Respondent(s): Mr.R.Vinothraja Government Advocate (Crl.Side) ORDER Petition seeking bail in connection with Crime No. 73 of 2026 registered for the offences punishable under Sections 126(2), 296(b), 309(4), 311, 351(3) of BNS @ 309(4), 311 of BNS, is on board for consideration. 2. The case of the prosecution is that the accused restrained the de facto complainant and robbed a sum of Rs.500/- from him by threatening him at knife point. Hence the case. 3. Learned counsel appearing for the petitioner/A2 submitted that the https://www.mhc.tn.gov.in/judis CRL OP No. 12434 of 2026 petitioner is an innocent person and has been falsely implicated in this case. He also submitted that the petitioner is suffering incarceration from 10.03.2026 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner. 4. Learned Government Advocate (Criminal Side) appearing for the respondent reiterated the prosecution case and opposed for the grant of bail. He further submitted that the petitioner is arrayed as A2 in this case and the first accused in this case has been detained under Act 14. He also submitted that the investigation is still pending and that in respect of the petitioner, eight previous cases are pending. Hence, opposes bail. 5. Heard both sides and perused the materials placed on record. 6. Considering the rival submissions on either side, nature of offence though there are several cases, in all cases, bail was granted to the petitioner, nobody injured in this case and considering the incarceration period spent by the petitioner for more than 50 days, I am inclined to grant bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned https://www.mhc.tn.gov.in/judis CRL OP No. 12434 of 2026 Judicial Magistrate No.1, Vellore, Vellore District and on further conditions that: [b] the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders. [c] the petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
