1. This misc. bail application has been filed by the petitioner Ashraf S/o Shri Mavasi, aged about 28 years under Section 483 B.N.S.S., who is behind the bars since 01.02.2026 in connection with the impugned FIR bearing No.527/2024 dated 30.11.2024 registered at Police Station Nadbai, District Bharatpur for the offences punishable under Sections 109(1) of B.N.S. and Section 3/25 of the Arms Act and Sections 3, 5 & 8 of the Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act, 1995.

Learned counsel for the petitioner submitted that co-accused person Salmu @ Salamuddin S/o Habib, who was also named in the FIR, has been enlarged on bail by a Co-ordinate Bench of this Court in SBCRLMB No.382/2025 vide order dated 21.02.2025.
Learned counsel for the petitioner further submitted that police

There are no criminal antecedents of the accused-petitioner and no recovery required to be made from the petitioner. In view thereof, learned counsel for the petitioner prayed that the petitioner be enlarged on bail.
3. Learned Public Prosecutor strongly opposed the bail application.

This Court after considering the fact that the charge-sheet has already been filed, trial will take sufficiently long time, nature of allegations, petitioner is behind the bar since 01.02.2026, there are no criminal antecedents, and after considering the overall facts and circumstances of the case, and co-accused has already been enlarged on bail by a Co-ordinate Bench of this Court, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner - Ashraf S/o Shri Mavasi on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Ashraf S/o Shri Mavasi shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.

6. It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
