Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months and till date, only charges have been framed and prosecution intends to examine 9 witnesses. Further the age of the accused is 52 years and that of the victim is 20 years. It has been submitted that the victim over a private dispute has falsely implicated the present petitioner. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary. Learned advocate for the State has drawn the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure as well as the documents relating to medico-legal examination. On an assessment of the same, I am of the opinion that prior to the
2 examination of the victim before the court, it would not be fit and proper to release the petitioner on bail. As such, at this stage, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 772 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
