JUSTICE ANU SIVARAMAN) Heard Sri Sandeep Lahiri, learned counsel appearing for the complainant, and Smt. Savithramma, learned Additional Government Advocate appearing for respondent No.4. 2. On 07.08.2025, the affidavit of compliance has also been placed on record. 3. The directions issued by the judgment dated 14.12.2022 in Writ Petition No.23357/2022 (GM-RES) are as follows: "2. The learned Senior counsel after arguing the matter at length would seek leave of this Court to withdraw the petition and submit a detailed representation to the Principal Secretary, Government of Karnataka, Revenue Department / Adjudicating Authority. In the event such a representation is submitted, the Adjudicating Authority shall consider the same, in accordance with law and pass appropriate orders. 3. Till the consideration of representation of the petitioner happens, the bank guarantee that the petitioner has furnished in furtherance of the contract shall not be revoked in terms of clause 8 of general conditions of the contract." - 4 - HC-KAR NC: 2026:KHC:31881-DB CCC No. 830 of 2024 4. It is the specific case of the Government that the representation submitted by the complainant had been considered on 18.07.2024 and thereafter, the Bank Guarantee was invoked on 23.07.2024. 5. It is submitted by the learned Additional Government Advocate and also the learned counsel for the complainant that the matter is now pending in arbitration proceedings and that, the matter is posted to 06.07.2026. 6. In view of the fact that an order had been passed on 18.07.2024 and it was pursuant to the same that the Bank Guarantee was invoked on 23.07.2024, we are of the opinion that an action for contempt would not lie. In the above view of the matter, the contempt of Court case is closed. However, we make it clear that we have not expressed any opinion on the merits of the matter or with regard to the order passed on 18.07.2024 or its implications. - 5 - HC-KAR NC: 2026:KHC:31881-DB CCC No. 830 of 2024 7. All issues or contentions of the parties are left open. 8. Notice, if any, issued to the accused shall stand discharged. All pending interlocutory applications shall stand closed.
