Accused No.3 in Crime No.102/2022 registered by Harihara Rural Police Station, Davanagere District, for the offence punishable under Sections 457 & 380 of IPC is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.102/2022 was registered by Harihara Rural Police Station initially for the offence punishable under Sections 454, 457 & 380 of IPC against unknown persons, based on the first information dated 12.07.2022 registered by Harihara Rural Police Station, Davanagere District received from Sri Suresh A. L S/o Late Lakshman. In the said case, petitioner is arraigned as accused no.3. The bail application filed by the petitioner under Section 482 of BNSS, 2023 before the Sessions Court in Crl.Misc.No.146/2026 was rejected on 23.02.2026.. In the first information which was submitted on 12.07.2022 it is stated that, the first informant who had locked his house had gone out on 11.07.2022. When he returned home at about 01.00 a.m. on the intervening night of 11.07.2022 and 12.07.2022 he found that the door of the house was broken. When he went inside, he found that gold and silver jewellery worth about ₹.10,17,500/- and cash of ₹.3,09,000/- was missing from his house. It is under these circumstances, he had approached the police at about 02.45 a.m. on 12.07.2022. In the said case, during the course of investigation, accused nos.1 and 2 were arrested and after completing investigation, charge sheet has been filed. Petitioner is arraigned as accused no.3 in the charge sheet. 5. Perusal of the material on record would go to show that, the petitioner has been throughout absconding and even in the charge sheet he is shown as absconding. After accused no.2 was arrested, major portion of the stolen articles were recovered from their possession. In the charge sheet, it is mentioned that an amount of ₹.50,000/- which was stolen from the house of the first informant is yet to be recovered from the - 4 - HC-KAR NC: 2026:KHC:32278 CRL.P No. 6823 of 2026 petitioner. Since the petitioner is absconding coercive action has been taken as against him by the Trial Court and non- bailable warrant is also issued. At this stage, he had approached the jurisdictional Sessions Court seeking anticipatory bail. 6. Considering the aforesaid aspects of the matter, learned Sessions Judge has rightly rejected the prayer for anticipatory bail by the petitioner.
