The Petitioner – wife of the detenu – Narayana (CTP No.01249) is before this Court seeking for the following reliefs: a) Set aside the Parole rejection endorsement dated 23-04-2026 bearing reference no. ¸ÀA: PÉÃPÁ²/eÉ 3/359/2026-27 vide Annexure-A and consequently; b) Pass order/direction by the nature of writ of mandamus to the Respondent No.02 to release the husband of the Petitioner i.e. Sri. Narayana S/o Lakshmana bearing CTP NO. 01249 on Parole for the period of 90 days. c) Also grant any other order/direction that this Hon'ble court may deem fit to grant under the facts and circumstances in the interest of justice and Equity. 2. The detenu had been convicted in Spl.C(P) No.11/2022 for offence under Section 4(2), 6 of POCSO Act r/w 376(2)(n), 376(AB) of IPC by the Additional District and Sessions Judge, (FTSC-I), Chikkamagaluru and sentenced on 19.04.2023 with the highest of the sentence being imprisonment for - 3 - HC-KAR NC: 2026:KHC:31485 WP No. 18114 of 2026 20 years. The detenu has served a period of 4 years 1 months 19 days of imprisonment as on 27.04.2026 and his conduct in jail is said to be satisfactory. The petitioner having made an application for parole, the same came to be rejected on account of adverse report having received by the police. 3. The reason sought for the parole is on the ground of carrying out agricultural activities. No particular document has been produced to substantiate the same.
