APHC010515712005 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI WRIT PETITION NO: 15536 of 2005 Bench Sr.No:-12 [3506] Birudula Ramakrishna ...Petitioner Vs. Government of Andhra Pradesh and others ...Respondents ********** Advocate for Petitioner : Mr. D. Prasad Kumar appearing vice Mr. V. V. N. Narayana Rao Advocate for Respondent : GP for Revenue CORAM : SRI JUSTICE CHALLA GUNARANJAN DATE : 17th February 2026 P C : The present Writ Petition is filed questioning the inaction of the respondents in providing employment under the rehabilitation scheme in pursuance of acquisition of the petitioner’s land under Award No.5/98-99, dated 06.01.1999, for the purpose of excavation of a canal under Cheedika Reservoir, as being illegal, arbitrary and unconstitutional. 2. The petitioner is stated to have parted with an extent of Ac.1.09 cents for the purpose of formation of a canal under the Cheedika Reservoir. The land was acquired and, eventually, under Award No.5/98-99, dated 06.01.1999, compensation was determined and paid. 3. However, petitioner’s representations, dated 08.09.2003, 03.10.2003 and 20.07.2004, seeking employment under the scheme for 2 CGR, J W.P.No.15536 of 2005 project-affected / displaced persons were not acted upon. Hence, he filed the present writ petition. 4. The respondent Nos.2 & 3 have filed counters, which are in tandem, and inter alia state that the land of the petitioner was acquired for the purpose of the formation of a canal under Cheedika Reservoir, a minor irrigation project. The claim for providing employment to land-affected families was envisaged only for notified medium and major irrigation projects and the project for which the land of the petitioner was acquired since does not fall under the aforesaid category, there is no such scheme for providing employment. 5. Even in the writ petition, the petitioner has not specifically pleaded nor, at the time of arguments, been able to establish as to there existed any scheme for providing employment to project affected families, much less for the Cheedika Reservoir project. 6. In that view of the matter, this Court does not find any merit in the writ petition and the same is accordingly dismissed. There shall be no order as to costs. Consequently, connected miscellaneous applications, if any, shall stand closed.
