JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in Crime No.157/2025, pending before the Principal Civil Judge and JMFC at Sira, Tumakuru District, for the offences under Sections 316, 318, 345, 347, 349 of BNS, 2023 read with Sections 103 and 104 of Trade Marks Act, 1999. 2. Heard Sri.Manjunath B.R, learned counsel appearing for the petitioners, Smt.Deepthi Alva, learned HCGP - 3 - HC-KAR NC: 2026:KHC:31875 CRL.P No. 8452 of 2026 appearing for respondent No.1, Sri.G.R.Praveen Kumar, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “We, (1) Rajeev Khanna, S/o Soraj Khanna, Aged about 56 years, (2) Himansh Khanna, S/O Rajeev Khanna, Aged about 31 years, (3) Manan Khanna, S/O Rajeev Khanna, Aged about 28 Years, all are residing at No.1882, Gali Ahiran, Maika Ganj, New-Delhi – 110 007 today at Bengaluru and Dhanalakshmi, W/O Dileep Kumar, Aged About 37 Years, Proprietor Of M/S. Jeeni Jeevitha Enterprises Yeragunte Village, Kasaba Hobli, Sira Taluk – 572 137 do hereby solemnly affirm and state on oath as follows: 1) We state that we are the petitioners No.1 to 3 and respondent No.2 in the above matter. 2) We state that, the respondent NO.2 is manufacturing and selling health mix products made from millets and other grains and through brand names like Jeeni Millets Traditional Mix, Junior Jeeni Traditional mix, Jeeni Sarihittu, Jeeni slip to prevent the misuse of their product and to ensure the customer safety they have established brand to protect their products and customers. The brand name of Jeeni has now become a trusted brand name among the customers. The petitioners without permission from the respondent NO.2 are misusing their trade mark and are selling fake/counterfeit products and under the brand name of - 4 - HC-KAR NC: 2026:KHC:31875 CRL.P No. 8452 of 2026 Jeeni on flip kart and other on-line and off-line markets. Upon the complaint of the respondent NO.2 herein a case was registered against the petitioners in Crime No.157/2025 for the alleged offences punishable under sections 316, 178, 345, 347, 349 of BNS read with section 103 and 104 of Indian Trade Mark act 1999 which was registered in Crime No.157/2025 of Kallambella Police, Sira Taluk, Tumukuru District pending on the file of Hon’ble Civil Judge and JMFC at Sira. 3) We state that at the intervention of the friends and well wishers and petitioners herein has stopped all alleged activities with immediate effect. The petitioners undertakes not to misuse the name, trademark, trade dress, copyright or packaging belonging to respondent NO.2 whether directly, through their henchmen, or though family members. Furthermore petitioners NO.1 to 3 hereby undertakes that they will not commit any similar offense henceforth either directly or thought their henchmen and family members. On the assurance both parties have arrived at an out of court settlement. Hence both the parties are preferring the present petition before this court for quashing the proceedings initiated against the petitioners. 4) We, state that, since both of us compromised the matter amicably, no further purpose would be served if the parties are made to contest the case even after the compromise between them. We, the deponents, do hereby state that what is stated above are true and correct, correct to the best of our knowledge, belief and information.” 4. In the light of application for compounding being filed along with the joint affidavit as quoted supra and offences not being against the State, I deem it appropriate to accept the joint affidavit and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Crime No.157/2025, pending before the Principal Civil Judge and JMFC at Sira, Tumakuru District, stands quashed qua the petitioners.
