JUSTICE H.P.SANDESH ORAL ORDER Both the parties and their respective learned counsel are present before the Court and they have filed an application under Section 147 of the Negotiable Instruments Act, wherein they have settled the matter to pay the entire fine amount. The respondent/complainant is given liberty to withdraw 50% of the amount, which is in deposit before the Trial Court and the petitioner has no objection to release the amount in favour of the respondent, on proper identification. In view of the settlement arrived between the parties, the petitioner has undertaken to pay the remaining amount of Rs.15,97,500/- to the respondent within four months from today. If the petitioner fails to pay the amount within four months from today, then liberty is given to the respondent/complainant to execute the - 3 - HC-KAR NC: 2026:KHC:32194 CRL.RP No. 509 of 2026 warrant against the petitioner through the process before the Trial Court. In paragraph No.2, it is stated that the petitioner has paid the balance amount of 50% i.e., Rs.9,61,500/- to the respondent/complainant through DD. The same is taken on record. 2. In view of the settlement arrived between the parties, the petitioner/accused is acquitted for the offence punishable under Section 138 of the Negotiable Instruments Act, subject to payment as agreed in terms of the settlement. The petitioner submits that he is going to deposit the fine amount of Rs.5,000/- within two weeks from today and produce the receipt before this Court for having deposited the amount. If he fails to produce the receipt before the Registry within two weeks from today, list the matter before the Court on 20.07.2026. 3. Accordingly, the revision petition is disposed of.
