JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this Court seeking for the following reliefs: a. Pass an order / direction or a writ of Mandamus to the respondent 2 to consider the representation of the petitioner vide Annexure-F to H, dated 26.07.2023 and 08.09.2023. - 3 - HC-KAR NC: 2026:KHC:30970 WP No. 6163 of 2024 b. Pass an order / direction to the respondent police to remove the name of the petitioner from the Rowdy Register maintained by the 5th respondent. 2. The petitioner claims to be a resident of Agraharabachahalli Village and the Secretary of the Karnataka Rakshana Vedike. On account of certain protests made by the petitioner along with certain others, proceedings were initiated against the petitioner in C.C.No.40/2018 for the offences punishable under Sections 143, 448, 353, and 114, read with Section 149 of IPC, further read with Section 4 of the Essential Services Maintenance Act, 2013, and the petitioner was acquitted on 21.08.2023. 3. Another proceeding is C.C.No.214/2017 under Sections 448, 341, 504 of the IPC has been compromised. One another proceeding in Crime No.128/2013 has been compromised before this Court in Criminal Petition No. 8725/2023, and as of now there is no other criminal proceeding which is pending against the petitioner. 4. It is on account of the pendency of those matters that a rowdy sheet has been opened in the name of the petitioner. Upon the acquittal and compromise, the petitioner submitted a representation on - 4 - HC-KAR NC: 2026:KHC:30970 WP No. 6163 of 2024 26.07.2023 and 08.09.2023 seeking for removal of the name of the petitioner from the rowdy sheet. The same not having been done, the petitioner is before this Court seeking for the following reliefs. 5. A rowdy sheet is normally opened against an habitual offender to monitor his activities. In the present matter, the three proceedings which were pending against the petitioner have all ended either in an acquittal or in a compromise, and as of now there are no proceedings which are pending against the petitioner. 6. If that be so, it is for the respondents to consider the representations of the petitioner dated 26.07.2023 and 08.09.2023 at Annexures-F to H and pass necessary orders within a reasonable period of time. The said representations are now pending for nearly three years, which cannot be said to be reasonable. As such, I pass the following: ORDER i) Writ petition is allowed. ii) A mandamus is issued directing the respondent No.2 to consider the representations dated 26.07.2023 and 08.09.2023 at Annexures-F and - 5 - HC-KAR NC: 2026:KHC:30970 WP No. 6163 of 2024 H within a period of four weeks and pass necessary orders. iii) The respondent No.5 would necessarily have to remove the name of the petitioner from the rowdy sheet register if there are no other proceedings pending against the petitioner.
