The prosecution case arises out of the written report of Raj Kumar Gope in which it has been alleged that on 07-03-2026 at around 08:25PM, he was present in Tito's Restaurant of which the informant is the owner when a person wearing a helmet and having a pistol in his possession shot at

the manager of the informant, Chotu Yadav who was present in the counter but he bent down as a result of which no bodily injury was suffered by Chotu Yadav. It has been alleged that one of the staffs of the informant, namely, Manish Gope was shot at and the bullet struck his abdomen as a result of which he fell down. The said miscreant after firing several rounds speedily came outside the restaurant and fled away on a motorcycle which was kept in a starting condition by one of his accomplices.
The informant and others took the injured Manish Gope to Raj Hospital where in course of treatment, he died. It has been alleged that after the incident there was a continuous flow of audio messages sent by the gangster Prince Khan on the mobile of Chotu Yadav and the son of Pushkar Mahto demanding extortion money. 7. It has been submitted by Mr. Rahul Dev, learned counsel for the appellant in Criminal Appeal (DB) No. 972 of 2026 that the appellant has been implicated on the confessional statement of a co-accused. No Test Identification Parade has been held to ascertain as to whether the appellant was present on the date of occurrence at the restaurant or not. The appellant is in custody since 17-03-2026 and one of the co-accused has been granted bail in B.A. No. 4555 of 2026. 8. Mr. Indrajit Sinha, learned counsel for the appellant in Criminal Appeal (DB) No. 799 of 2026 has submitted that the name of the appellant has surfaced on suspicion on the confessional statement of co-accused. The appellant has a trading company in the name of R.K. Raj Farming and Supply and on the date of occurrence he was at Bengaluru. It has been submitted that the appellant has one criminal antecedent in which he is on bail. 9. Mr. K.S. appellant has also been implicated on the confessional statement of co-accused. The appellant has not been put on Test Identification Parade and he is in custody since 17-03- 2026 and charge sheet has been submitted by the Police. The appellant also does not have any criminal antecedent. 10. Learned A.P.P./Special P.P./P.P. along with the
learned counsel for the informant have opposed the prayer for bail of the appellants and have submitted that in course of investigation, incriminating materials have been collected against the appellant. 11. The learned State counsel has produced a copy of the Case Diary and the name of the appellant Afjal Aman and Md. Shadab Alam have first surfaced on the confessional statement of Kuber alias Manish Singh alias Amar Singh recorded at Para 91 of the Case Diary. This accused has stated about the manner of occurrence and the persons involved in firing at the deceased. He has also disclosed about transfer of an amount of Rs. 3 lakhs by Afjal Aman in the account of Basit Ansari and the receipt was sent to the Zangi app of Afjal Aman. The confessional statement of the appellant Afjal Aman finds place at Para 95 of the Case Diary. On the pointing out by both the apprehended accused, the Police had surrounded an area, but firing started from inside and the appellant Afjal Aman had tried to escape following such firing, but he was apprehended which is apparent from Para 102 of the Case Diary. The appellant Shadab Alam alias Doctor was also apprehended by the Police and his confessional statement has been recorded at Para 114 of the Case Diary. The involvement of the appellant Rana Rahul Singh has come to light at Para 183 and 184 of the Case Diary which contains the restatement of Rajkumar Gope and Pushkar Mahto wherein they have stated that Kaushal Kumar Pandey had made available the

photographs of Pintu Kachhap from Facebook to Rana Rahul Singh and Prince Khan. Para 216 of the Case Diary contains another detailed confessional statement of the appellant Afjal Aman. It also appears that the accused Sachin Kumar was put on Test Identification Parade and the informant Rajkumar Gope as well as Chotu Kumar Yadav had identified him as the person who had made firing in the restaurant. It appears that from the possession of the appellant Afjal Aman, a Vivo mobile was recovered and the chatting showed his involvement in the incident which took place at Tito's restaurant. 12.
The confessional statement of Afjal Aman (Criminal Appeal DB No. 972 of 2026) is backed up by other materials including the screenshot on his Vivo mobile which depicts the conspiracy hatched by the appellant of creating terror in Tito's restaurant and such evidence would not implore us to admit him on bail. Accordingly, Criminal Appeal (DB) No. 972 of 2026 stands rejected. 13. So far as the appellant Shadab Alam alias Doctor in Criminal Appeal (DB) No. 940 of 2026 is concerned, the only incriminating material is the confessional statement of other co-accused and his own confessional statement. We, therefore, in view of the dearth of concrete materials against this appellant set aside the order dated 23-05-2026 passed by the learned Additional Judicial Commissioner-XII, Ranchi in B.P. No. 422/2026 arising out of Airport P.S. Case no. 12/2026 and direct that the appellant be released on bail on furnishing bail bond of of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Ranchi, in connection with Airport P.S. Case no. 12/2026. 14. Save and except a fleeting reference of the appellant in Criminal Appeal (DB) No. 799 of 2026, nothing incriminating has been collected against him. In such

circumstances, therefore, the appellant Rana Rahul Singh in Criminal Appeal (DB) No. 799 of 2026 is directed to surrender before the learned trial court within a period of 4 weeks, and on his surrender, he shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Ranchi in connection with Airport P.S. Case No. 12/2026. 15. As a consequence to the above, Criminal Appeal (DB) No. 799 of 2026 and Criminal Appeal (DB) No. 940 of 2026 are allowed, while Criminal Appeal (DB) No. 972 of 2026 stands dismissed. 16. Pending I.A.(s), if any, stands closed.
