p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.1118 of 2026 Abdul Muslim Khan @ Muslim Khan @ Pinkulu …. Petitioner Mr. Amitav Tripathy, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. K. Lenka, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 08.04.2026 I.A. No.544 of 2026 02. 1. Heard learned counsels for the respective parties. 2. Instant I.A. is filed for seeking expunge of the condition vis-à-vis verification of criminal antecedent of the petitioner, directed by this Court in the ABLAPL for the reasons stated. 3. Mr. Tripathy, learned counsel for the petitioner submits that the other two cases in respect of which instruction earlier received about acquittal of the petitioner found to be incorrect as they are pending disposal as such there are three criminal antecedents against him and not one, therefore, the Court’s order dated 23rd February, 2026 in the ABLAPL needs modification especially with regard to the condition on antecedent is concerned. Recorded the submission of learned counsel for the State. p. 2 4. This Court is inclined to expunge the condition on criminal antecedent modifying the Court’s order in the ABLAPL dated 23rd February, 2026, instead to direct the petitioner to furnish an undertaking to not involve himself in similar criminal activities, while on bail. 5. Accordingly, the I.A. is disposed of. Consequently, the order in the ABLAPL shall be read as with reference to having no any condition on criminal antecedent, instead, release of the petitioner shall be subject to compliance of other conditions. At the same time, the petitioner is hereby allowed to surrender within the extended period of time by 30th April, 2026, as in the meantime, the earlier timeline fixed has expired. (R.K. Pattanaik) Judge Sumitra
