Accused no.6 in Crime No.32 of 2026 registered by Sakharayapatna Police Station, Chikkagamagluru District, for offences punishable under Sections 310(2) & 311 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.32 of 2026 was registered by Sakharayapatna Police Station, Chikkagamagluru District initially, for offences punishable under Sections 310(2) and 311 of BNS, 2023, based on first information dated 11.03.2026 received from Sri Praveen K, who is one of the alleged victims in the present case. During the course of investigation, petitioner herein was arrested on 11.03.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court was rejected on 23.04.2026. Therefore, he is before this Court. - 3 - HC-KAR NC: 2026:KHC:31928 CRL.P No. 7063 of 2026 4. In the first information, which is filed by one of the victims on 11.03.2026, it is averred that on 10.03.2026, when he and his friend Chetan, who is the other victim in the present case, were traveling to Chikkamagaluru in the car bearing registration no. KA- 44M-9524, his friend Shivu allegedly asked him to pick up his relatives on their way to Chikkamagaluru. Accordingly, at about 10.00 a.m. the victims in the present case on their way to Chikkamagaluru had picked up two girls by name Shravya and Kavya in their car. On the way, one of the girls allegedly telephoned to somebody and subsequently the car was stopped at the request of one of the girls at about 10.45 p.m. 5. It is alleged that, at that time about five unknown persons, who came there in a motorcycle had allegedly snatched the car key from the first informant and after assaulting the victims in the present case, the said persons allegedly demanded money from them. At that time, a jeep with siren came there and thereafter the accused persons allegedly escaped from the spot along with the belongings of the victims. - 4 - HC-KAR NC: 2026:KHC:31928 CRL.P No. 7063 of 2026 6. Petitioner, who has no other criminal antecedent has been arrested in the present case was arrested on 11.03.2026. It is brought to the notice of this Court that investigation of the case is now completed and charge sheet has been filed. The alleged offences are not exclusively punishable with life imprisonment or death sentence. 7. Considering the aforesaid aspects of the matter and also having regard to the nature of allegations found in the first information, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 8. Accordingly, the following:- ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.32 of 2026 registered by Sakharayapatna Police Station, Chikkagamagluru District, for offences punishable under Sections 310(2) & 311 of BNS, 2023, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:31928 CRL.P No. 7063 of 2026 a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
