Accused in Crime No. 114/2026 registered by R.T. Nagar Police Station, Bangalore, for offences punishable under Sections 75, 79 of BNS 2023 and Sections 11(iii) and 12 of POCSO Act, is before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP for the respondent. Respondent No.2 who is served in the matter has remained unrepresented before this Cout. - 3 - HC-KAR NC: 2026:KHC:31904 CRL.P No. 7330 of 2026 3. FIR in Crime No.114/2026 was registered by R.T. Nagar Police Station, Bangalore for the aforesaid offences against the petitioner herein, based on the first information dated 09.04.2026 received from the paternal aunt of the victim girl aged 17 years. In the said case petitioner was arrested on 13.04.2026. His bail application filed before the jurisdictional Sessions Court in Crl.Misc. No. 3713/2026 was rejected on 12.05.2026. Therefore, he is before this Court. 4. In the first information submitted on 09.04.2026, it is stated that victim girl is the daughter of the first informant's elder brother, who had died on 17.11.2021. After his death, mother of the victim girl started residing with the petitioner herein with whom she had an illicit relationship. Allegation now made against the petitioner is that he had sent obscene messages and videos to the mobile phone of the victim girl and sought sexual favours from her. The petitioner who is arrested in the present case on 13.04.2026 has no other criminal antecedent. - 4 - HC-KAR NC: 2026:KHC:31904 CRL.P No. 7330 of 2026 Investigation of the case is completed and charge sheet is filed. Maximum punishment for the alleged offences is imprisonment for a period of 5 years. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.114/2026 of R.T. Nagar Police Station registered for the offences punishable under Sections 75, 79 of BNS, 2023 and under Sections 12, 11(iii) of POCSO Act, 2012, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court - 5 - HC-KAR NC: 2026:KHC:31904 CRL.P No. 7330 of 2026 unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE BVK List No.: 1 Sl No.: 69
