JUSTICE MUNNURI LAXMAN Order 24/04/2026 1. With the consent of the learned counsel for the petitioner, the matter is heard for final disposal at the admission stage itself. 2. The present writ petition has been filed challenging the inaction on the part of the respondents in not paying the gratuity in pursuance of the conclusion of criminal proceedings in the criminal court. 3. The case of the petitioner is that the petitioner was allegedly involved in a criminal case and during the pendency of the criminal case, the petitioner retired. At the time of retirement, the gratuity was withheld on account of the pendency of the criminal case. It is his submission that the criminal case resulted in acquittal and now there is no other proceedings parallelly pending [2026:RJ-JP:17572] (2 of 2) [CW-782/2026] on the same allegation and there is no appeal against the order of acquittal. 4. The limited grievance of the petitioner is that he issued a notice calling upon the respondents to pay the gratuity in consequence of the judgment of acquittal in the criminal case. 5. Considering the limited grievance of the petitioner, the writ petition is disposed of, directing the respondents to consider the notice issued by the petitioner and decide the entitlement of the petitioner with regard to gratuity, keeping in view the judgment of acquittal in the criminal case. The said exercise shall be completed within a period of one month from the date of receipt of a copy of this order. 6. All pending applications, if any, stand disposed of.
