The present criminal appeal is directed against the Judgment of conviction dated 18.12.2018 and order of sentence dated 20.12.2018, passed by the learned District & Additional Sessions Judge – VI, Gumla, in S.T No.136 of 2013, arising out of Raidih P.S. Case No.24 of 2011 (G.R. No.338 of 2011), whereby the appellant has been convicted for the offence under Sections 25(1A)/ 35, 26(2)/ 35 of the Arms Act, and has been sentenced to undergo rigorous imprisonment for six years with fine of Rs.6,000/- (Six thousand) with default clause for the offence under Section 25(1A)/35 of the Arms Act, rigorous imprisonment for six years with fine of Rs.6,000/- (Six thousand) with default clause for the offence under Sections 26(2)/ 35 of the Arms Act. All the sentences were directed to run concurrently. 2. It has been reported that the appellant is no more. This fact has also been certified by the State by filing an affidavit dated 10.08.2026 wherein it has been disclosed that the appellant has died during pendency of this appeal four years back. 3. Learned counsel for the appellant has submitted that he has no instruction from the legal heirs of the deceased appellant to pursue the present appeal. 4. In that view of the matter, the present criminal appeal is, hereby, dismissed as infructuous. 5. Pending interlocutory application, if any, stands disposed of.
