JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners - accused Nos.1, 2 and 3 are before the Court calling in question an order dated 12.01.2026, passed by the II Additional Senior Civil Judge and JMFC, Tumakuru, in C.C.No.33/2025, whereby, the concerned Court rejects an application filed by the petitioners – accused under Section 91 of the Cr.P.C. seeking certain documents i.e., call record details - 3 - HC-KAR NC: 2026:KHC:31936 CRL.P No. 1200 of 2026 and tower locations, to prove their case before the concerned Court. 2. Heard Sri Anand K., learned counsel for petitioner, Smt. Rashmi Patel, learned High Court Government Pleader for respondent No.1 – State and Sri Venkataraman Naik, learned counsel for impleading applicant in I.A.No.2/2026. 3. This Court grants an interim order of stay of further proceedings before the concerned Court on the score that the application should have merited favourable consideration in favour of the accused. 4. Sri Venkataraman Naik, learned counsel appearing for the impleading applicant, the complainant would submit that the application may be allowed. 5. Learned counsel for the petitioners at this juncture would submit that the Investigating Officer has already placed those documents, on record. - 4 - HC-KAR NC: 2026:KHC:31936 CRL.P No. 1200 of 2026 6. In the light of the afore-made submissions of the learned counsel for the parties, the following: ORDER a. The criminal petition stands disposed. b. As a matter of form, the impugned order dated 12.01.2026, passed by the II Additional Senior Civil Judge and JMFC, Tumakuru, which rejects the application filed by the petitioners under Section 91 of the Cr.P.C. stands quashed. c. The document that is already placed on record by the Investigating Officer shall be put into use as is sought for by the petitioners or the respondent, as the case would be before the concerned Court.
