This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No.594/2025 registered at Police Station – Champa, District- Janjgir-Champa (C.G.), for the offence under Sections 109(1), 309(6), 331(6), 111(2), 117(2) and 3(5) of the BNS, 2023. The prosecution case, in brief, is that on 10.12.2025 at about 6:30 PM the complainant received a call from his mother informing him that when she was preparingArun Rajput to go outside, three boys entered the house after unlocking the door and assaulted her with an iron tool, as a result of which she sustained injuries and fell to the ground. It is further alleged that the Applicant along with other co-accused persons looted her bentex earrings. On the basis of the said report, the police registered an offence as mentioned above against the present Applicant. Hence, this application. 3. Learned counsel for the Applicant submits that the present Applicant is innocent and has been falsely implicated in this case. He further submits that the Applicant has not been named in the FIR, the medical report has not supported the case of the prosecution and no bone injury has been found in the MLC. He lastly submits that the present Applicant is behind the bars since 11.12.2025, the charge-sheet has already been filed and the trial is likely to take considerable time, therefore, he may be granted regular bail. 4. On the other hand, learned State counsel opposes the bail application and submits that there is one previous criminal antecedent against the present Applicant, to which learned Counsel for the Applicant submits that it pertains to a minor 3 offence. Learned State counsel further submits that the Applicant has been duly identified by the injured in the test identification parade and that recovery of ornaments has also been made from his possession. It is further submitted that the victim has sustained injuries on her person, therefore, the Applicant is not entitled to be released on bail. 5. Having heard learned Counsel for the parties and considering the facts and circumstances of the case, particularly that the Applicant has been duly identified by the injured in the test identification parade, recovery of ornaments has also been made from his possession and the victim has sustained injuries, this Court is not inclined to grant bail to the Applicant, at this stage. 6. Accordingly, the bail application of the applicant – Arun Rajput involved in Crime No.594/2025 registered at Police Station – Champa, District- Janjgir-Champa (C.G.), for the offence under Sections 109(1), 309(6), 331(6), 111(2), 117(2) and 3(5) of the BNS, 2023 , is hereby rejected. 7.
