The Petitioner – father of the detenu – M.V.Basavaraju (CTP No.13424) is before this Court seeking for the following reliefs: 1. Issue a writ of certiorari or a writ or order or direction of appropriate in nature in quashing the Endorsement dated 27/04/2026 in BCP/J3/578/2026 as per ANNEXURE-A as illegal, arbitrary and oppressive. 2. To issue a writ of mandamus or a writ or direction of appropriate in nature directing the respondents to grant 90 days General Parole to the prisoner M.V BASAVARAJU S/O VENKATARAMU(CTP-13424), on such terms and conditions, and 3. The detenu had been convicted in Spl.CC No.138/2022 for offence under Section 6 of POCSO Act and Section 506 of IPC by the Additional District and Sessions Judge, (FTSC-I), Tumkuru and sentenced on 02.03.2023 with the highest of the sentence being imprisonment for life. The detenu has served a period of 4 years 2 months 16 days of imprisonment as on 11.05.2026. The petitioner having made an application for parole, the same came to be rejected on account of adverse report having received by the police. 3. The reason sought for the parole is on the ground of carrying out agricultural activities. No particular document has been produced to substantiate the same.
