The Petitioner – mother of the detenu – Shivanna (CTP No.13253) is before this Court seeking for the following reliefs: 1. To issue a writ of mandamus or a writ or direction of appropriate in nature directing the respondents to grant 90 days General Parole to the prisoner SHIVANNA S/O RAMACHANDRAPPA(CTP-13253),on such terms and conditions, and 2. To issue a writ or order or direction of appropriate in nature granting such other relief or reliefs as this Hon'ble Court deems fit, to grant in the ends of Justice. 2. The detenu had been convicted in Spl.C No.92/2020 for offence under Section 6 and 8 of POCSO Act, 2012 by the Additional District and Sessions Judge, - 3 - HC-KAR NC: 2026:KHC:31394 WP No. 17151 of 2026 (FTSC-I), Tumkuru and sentenced on 19.12.2022 with the highest of the sentence being imprisonment for life. The detenu has served a period of 3 years 11 months 15 days of imprisonment as on 11.05.2026. The petitioner having made an application for parole, the same came to be rejected on account of adverse report having received by the police. 3. The reason sought for the parole is on the ground of carrying out agricultural activities. No particular document has been produced to substantiate the same.
