JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.192/2021 for the offences punishable under Sections 498A, 323, 506 read with Section 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act,1961. - 3 - HC-KAR NC: 2026:KHC:31868 CRL.P No. 4595 of 2026 2. Heard Sri. Prakash Reddy C., learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned HCGP appearing for respondent No.1, Sri. Rakshith R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Memorandum of Compromise Petition along with the joint affidavit in that regard. The said Memorandum of Compromise Petition reads as follows: “MEMORANDUM OF COMPROMISE PETITION BY WAY OF JOINT MEMO FILED UNDER SECTION 482 OF CODE OF CRIMINAL PROCEDURE We Yadavali Vekata Ravikumar, S/o Yadavalli Venkaya Subbaiah, Aged about 35 years, R/a No.B-08, 2nd floor, 18th c cross, Rajashree Layout, Munnekolala, Marathahalli, Bangalore-560037 AND Yedavalli Venkaya Subbaiah, S/o. Late Ramaiah, Aged about 63 years, Residing at P.R. Palli, Peddireddipalle, Nellore, Peddireddypalli, Andra Pradesh-524236 AND Smt. Yadavalli Anantha Lakshamma, D/o K.s., Aged about 58 years, Residing at P.R. Palli, Peddireddipalle, Nellore, Peddireddypalli, Andra Pradesh-524236 AND Amrutha, W/o Ravikumar.Y.V., Aged about 27 years, R/a No.Myalar Lingeshwara Swamy Nilaya, No.6, Rainbow Layout, 5th Cross, Dental College road, Munnekolala, Bengaluru- 560037 do hereby state as follows: 1. It is submitted, the petitioners and the complainant who is Respondent No.2, are well conversant with the facts - 4 - HC-KAR NC: 2026:KHC:31868 CRL.P No. 4595 of 2026 and circumstances of the above petition, and hence we are swearing this joint memo. 2. We state that the petitioners are arrayed as Accused persons in Cr.No.192/2021 for the alleged offences under section 498A, 406, 323, 417, 506 r/w 34 of IPC and section 3 & 4 of DP Act. 3. We state that the above petition is filed by the petitioners praying to quash the proceedings against this petitioners in No. 192/2021 of the Marathahalli PS for the offence punishable under section 498A, 323, 506 r/w 34 of IPC and section 3 & 4 of DP Act pending on the file of XXIX Addl Chief Judicial Magistrate, Mayohall at Bangalore in C.C.No.58075/2021. 4. We state that, due to the intervention of well-wisher we have amicably arrived at a Compromise. 5. We state that the in view of the compromise arrived between the petitioners and respondents, the respondent no.2 has duly agreed to withdraw the case filed by her against the petitioner No.1 to 3 in Cr.No.192/2021 for the alleged offences under section 498A, 406, 323, 417, 506 r/w 34 of IPC and section 3 & 4 of DP Act. 6. We state that the petitioner no.1 and Respondent No.2 had filed a petition under section 138 of Hindu Marriage Act praying to dissolve the marriage between Petitioner No.1 and Respondent No.2, solemnized as per the Hindu rites and rituals on 16.02.2020 at Peddireddypalli, Brahmanapalli village, Vaikuntapodu Mandal, Nellore district Andhra Pradesh. The Learned I Addl. Prl Judge, Family Court, Bangalore vide decree dated 08.01.2026 has dissolved the marriage solemnised on 16.02.2020. 7. We stat that the petitioner no.1’s brother and son of petitioner no.2 & by name Yadavalli Praveen Kumar has agreed to withdraw the case filed by him against Respondent No.2’s family members in CC No.83/2023, pending on the file of Addl Junior Civil judge, Armoor. 8. We state that, due intervention of well-wishers we entered into compromise, said compromise is entered into by us with our own will and there is no coercion of undue pressure created by any third parties to enter into this compromise. - 5 - HC-KAR NC: 2026:KHC:31868 CRL.P No. 4595 of 2026 9. It is submitted that both the parties state that the petitioners and Respondent No.2 have no other claims of whatsoever nature against each other past, present or further. 10.We state that, if this compromise petition is not accepted we will be put to greater hard ship and inconvenience which cannot be compensated in any manner. WHEREORE, we pray that this Hon’ble court be pleased to accept this compromise petition by way of Joint Memo to Quash the proceedings against this petitioners in No.192/2021 of the Marathahalli PS for the offence punishable under section 498A, 323, 506 r/w 34 of IPC and section 3 & 4 of DP Act pending on the file of XXIX Addl Chief Judicial Magistrate, Mayohall at Bangalore in C.C.No.58075/2021 in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Memorandum of Compromise Petition as quoted supra being filed and offences not being against the State, I deem it appropriate to accept the said Memorandum of Compromise Petition and terminate the proceedings against the petitioners in the subject petition. 6.
