---- 02/31.08.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Mahagama P.S. Case No.89 of 2025, for the alleged offences registered under Sections 109, 126(2), 127(2) and 61(2) of Bharatiya Nyaya Sanhita, 2023 and Section 27 of Arms Act pending in the Court of learned J.M.F.C., Godda.

Learned counsel appearing for the petitioners submits that the petitioners are not named in the FIR and the name of the petitioners have come on the confessional statement. He further submits that allegations are made of firing, however, there is no injury report. He

then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.10 of the petition. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that the petitioners are accomplice of apprehended co- accused and in view of that anticipatory bail of the petitioners may kindly be rejected.

Considering that the petitioners are not named in the FIR and the name of the petitioners have come on the confessional statement and the petitioners have got no criminal antecedent as disclosed in paragraph No.10 of the petition and even the injury report is not there, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned J.M.F.C., Godda in connection with Mahagama P.S. Case No.89 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
