This is the first bail application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 before this Court. The applicant has been arrested on 18-02-2026 in connection with Crime No.61/2026 registered at Police Station City Kotwali, District- Raipur (C.G.) for the offence under Section 6 of the Chhattisgarh Gambling Prohibition Act, 2022 (mentioned as Section 6 of Gambling Act in the present bail application). 2. The case of the prosecution is that, on 18-02-2026 during patrolling the police of Police Station City Kotwali, District Raipur after receiving a secret information, conducted raid near Shiv Mandir, Gandhinagar, Kalibadi, Raipur and found the applicant engaged in playing chit gambling. From the applicant four gambling chit and Rs.1,740/- cash, one blue dot pen and one piece of carbon have been seized. The offence has been registered and after Digitally signed by MOHAMMED AADIL KHAN Date: 2026.07.04 18:06:08 +0530 2 investigation charge sheet has been filed. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in the offence only on suspicion. Since the applicant is having two criminal antecedents and in all these two criminal antecedents he has been acquitted, to make pressure upon him to extort money, the police persons arrested him for the alleged offence. The applicant has been arrested on 18-02-2026 and he was not involved in any chit gambling. The alleged gambling chit has been prepared by the police subsequently. In all other offences the applicant has been acquitted by the learned trial Court. The offence is triable by the Judicial Magistrate First Class. The applicant is in jail since 18-02-2026 and the final adjudication of the case will take its own time. Therefore, he may be enlarged on bail. 4. On the other hand, learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material available in the case diary against the applicant, further that in all other two antecedents the applicant has been acquitted and he is in jail since 18-02-2026 and that the offence is triable by the Judicial Magistrate First Class, without commenting anything on merit of the case I am inclined to release the applicant on bail. 7. Accordingly, the application filed by the applicant for grant of regular bail is allowed. 8. It is directed that the applicant Sahdev Tandi shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, on following conditions that :- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as 3 to dissuade him from disclosing such fact to the Court, (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial unless his personal presence is exempted by the trial Court.
