This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be DEEPTI JHA Digitally signed by DEEPTI JHA 2 pleased to direct the respondents No.2 to 7 to direct the respondent No.8 to comply with the order dated 31.03.2025 passed by the respondent No.2 for contract and for grant of lease to the petitioner’s society while deciding the representations. 10.2 That this Hon’ble Court may kindly be pleased to direct the respondent No.2 to take necessary action against the respondent No.8 for non-compliance of order dated 31.03.2025. 10.3 That, this Hon’ble Court may kindly be direct the respondent No.2 to direct the respondent No.8 to make contract for fishing production as per order dated 31.03.2025 while completing all the formalities as per order dated 31.03.2025 and give permission to the petitioner society for fishing production as per the order dated 31.03.2025. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.” 3. Learned counsel for the petitioner submits that lease has been granted to the petitioner society vide order dated 31.03.2025 by the Deputy Director Fisheries, District Sakti (C.G.) with a direction to the Gram Panchayat, Beladula to execute an agreement with the petitioner society. However, till date inspite of filing of several representations / applications by the petitioner society, lease deed has not been executed by the concerned Gram Panchayat, as such petitioner society was restrained to file this writ petition. 4. Learned State counsel submits that so far as the State authorities are concerned, they have already granted permission by which the petitioner society has been granted lease. Now the Gram Panchayat is ready to execute the agreement as per the Chhattisgarh New Fisheries Policy, 2022. 5. I have heard learned counsel for the parties and perused the material available on record. 3 6. From perusal of record, it appears that vide order dated 31.03.2025, the concerned Deputy Director Fisheries has already passed the permission for grant of lease in favour of the petitioner society and the concerned Sarpanch Secretary, Gram Panchayat, Beladula, Block Jaijaipur, District Sakti (C.G.) was directed to execute agreement and to receive the requisite fees and to deposit the same in the funds of Panchayat. However, the concerned Gram Panchayat has not taken any action in this matter inspite of repeated representations / applications filed by the petitioner. Once the concerned department of Deputy Director Fisheries passed an order dated 31.03.2025 while granting lease in favour of the petitioner society, the concerned Sarpanch and Secretary of Gram Panchayat, Beladula are under the obligations to execute an agreement with the petitioner society while taking the respective fees of the same, they cannot deviate from the same. Accordingly, the concerned Gram Panchayat is directed to comply with the order dated 31.03.2025 and to execute the lease deed within a period of 30 days from the date of receipt of copy of this order. 7. It is directed to the petitioner society to file appropriate application along with copy of this order before the Gram Panchayat for compliance of the order dated 31.03.2025. 8. With the aforesaid observation and direction, this writ petition stands disposed of. 9. Interlocutory application(s), pending if any, also stands disposed of.
