JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.19 of 2026 registered by BEML Nagar Police Station, KGF for offences punishable under Sections 189(2), 189(4), 191(2), 115(2), 118(1) 352, 351(2) r/w Section 190 of BNS 2023 is before this Court in this petition filed under Section 483 of BNSS 2023, seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.19 of 2026 was registered by BEML Nagar Police Station, KGF for the aforesaid offences - 3 - HC-KAR NC: 2026:KHC:31685 CRL.P No. 6976 of 2026 against one Ajay and others, based on the first information dated 13.04.2026, received from one Sanjay, who is one of the injured victim in the present case. Petitioner who is arraigned as accused No.2 in the FIR was arrested on 15.04.2026 and remanded to custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.355 of 2026 was rejected on 29.04.2026. Therefore, he is before this Court. 4. A reading of the first information would reveal that the accused persons who are known to each other had fought against each other at about 16.00 hours on 13.04.2026 and in the said incident, allegation as against the petitioner herein is about assaulting Rishi, friend of first informant-Sanjay, with a stone on his back. Undisputedly, Rishi has suffered only simple injury, as a result of assault made by the petitioner. There is no allegation as against the petitioner about he assaulting first informant - Sanjay. He is in custody, in the present - 4 - HC-KAR NC: 2026:KHC:31685 CRL.P No. 6976 of 2026 case, for the last more than two months. Under the circumstances, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.19 of 2026 of BEML Nagar Police Station, KGF registered for the offences punishable under Sections 189(2), 189(4), 191(2), 115(2), 118(1) 352, 351(2) r/w Section 190 of BNS 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the like-sum, to the satisfaction of the Jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR NC: 2026:KHC:31685 CRL.P No. 6976 of 2026 d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE DH List No.: 1 Sl No.: 45
