Accused nos.1, 3 & 4 in Crime No.118/2026 registered by Bilikere Police Station, Mysuru District, for the offences punishable under Sections 314, 316(5), 318(4), 319(1), 335, 336(1), 336(2), 336(3), 336(4), 190 of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.118/2026 was registered by Bilikere Police Station, Mysuru District, for the aforesaid offences against the petitioners herein and another based on the first information dated 28.03.2026 received from Sannanayaka. - 3 - HC-KAR NC: 2026:KHC:31659 CRL.P No. 6868 of 2026 Apprehending arrest in the said case, petitioners had filed Crl. Misc. No.5102/2026 before the jurisdictional Sessions Court which was rejected on 23.04.2026. Therefore, they are before this Court. 4. Perusal of the typed first information submitted by the first informant on 28.03.2026 would go to show that, he claims to be the successor to the land bearing Sy. No.99/1 measuring 4 acres 16 guntas, which according to him, belonged to his grandfather Puttanayaka. After the death of his grandfather, his father Kanthanayaka allegedly had succeeded to the same. Undisputedly, revenue records of the said land were never transferred in the name of the father of the first informant or the first informant at any point of time. 5. Learned Counsel for the petitioners has produced material before this Court to show that there is a revenue dispute pending before the jurisdictional Tahsildar in respect of the very same property in which accused nos.2 & 3 in the present case are arrayed as respondents. It appears that the first informant had filed an impleading application in the said proceedings and subsequently, the present FIR has been registered with the - 4 - HC-KAR NC: 2026:KHC:31659 CRL.P No. 6868 of 2026 allegations that petitioners herein have concocted documents in respect of the aforesaid property belonging to the grandfather of the first informant and created documents in their favour. Learned Counsel for the petitioner has also brought to the notice of this Court that there is already a civil dispute pending before the jurisdictional civil court in O.S.No.108/2026 in respect of the very same property. Under the circumstances, I am of the opinion that petitioners' prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.118/2026 registered by Bilikere Police Station, Mysuru District, for the offences punishable under Sections 314, 316(5), 318(4), 319(1), 335, 336(1), 336(2), 336(3), 336(4), 190 of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with - 5 - HC-KAR NC: 2026:KHC:31659 CRL.P No. 6868 of 2026 two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
