The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023 for releasing him on regular bail during trial in connection with Crime No. 122/2024 registered at Police Station – Kasabell, District – Jashpur (C.G.) for the offence punishable under Sections 61(2), 332(B), 312, 309, 311, 103, 111 of BNS and Sections 25(1-B)/B and 27 of Arms Act. 2. In this case, 4 accused persons are involved. As per the prosecution’s case, on 06.11.2024 at about 11:00 am, the applicant along with other co-accused persons, entered the complainant’s Customer Service Center (a Kiosk Bank) to commit robbery, having formed a criminal conspiracy and armed themselves with a country-made firearm. During the incident, when the complainant’s grandmother, Urmila Bai, intervened, the accused fired at her, resulting in her death. Based on this, offence has been registered against the present applicant and other co-accused persons. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He next submits that one co-accused, namely Situl Ram has already been granted bail by this Court on 30.03.2026 in MCRC No. 2463/2026, therefore, the present applicant may also be granted benefit of bail. He also submits that the applicant is in jail since 06.11.2024, and there is no likelihood of his case being decided in the near future, therefore, the present applicant may be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the co-accused Situl Ram, who has been granted bail by this Court, has no active role in the robbery as he was not present on the spot.
But the present applicant has an active role in the matter, who was also entered into the Bank along with other co-accused persons and in the test identification parade, he was identified. He next submits
3 that there is a seizure of a jacket (clothe), mobile phone and face mask from the present applicant. As such, the present applicant's case is different from that of the co-accused, Situl Ram, who has been granted bail. The present applicant is not entitled to be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly looking to the material available on record and the evidence against the applicant, at this stage, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 7. However, considering the fact that the applicant is in jail since 06.11.2024, the concerned trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible. 8.
