JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.145/2018, pending before the 3rd Addl. Civil Judge (Jr. Dn) and JMFC, Anekal, Bengaluru Rural District, for the offences under Sections 420, 468, 471, 406 read with 34 of Indian Penal Code. 2. Heard Sri.Mahesh M.R., learned counsel appearing for the petitioner, Sri.K.Nageshwarappa, learned HCGP - 3 - HC-KAR NC: 2026:KHC:30591 CRL.P No. 6050 of 2026 appearing for respondent No.1, Smt.Sowmya Murugesan, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The said Joint Memo reads as follows: “1. The Respondent No.2 and 3 submits that, they have purchased the site from the petitioner bearing Site No.86, Katha No.116/86, Sy. No.135/1, measuring 1500 Sq.feet. 2. The Respondent No.2 and 3 submits that, after purchasing the site from the petitioner the Respondent No.2 and 3 obtained the E.C and came to know that the above site was sold to some other person, earlier to Respondent No.2 and 3 purchasing the same. In this regard the Respondent No.2 and 3 filed a case against the petitioner before the Respondent No.1 in Crime No. 209/2017 (CC No.145/2018). 3. Now the Respondent No.2 and 3 and the Petitioner have amicably settled the matter with intervention of well-wishers. 4. The Respondent No.2 and 3 submits that, they have received all the sale deed amount from the petitioner whatever they have paid at the time of registration. 5. The Petitioner and Respondent No.2 and 3 entered into s cancelation deed on 27-02-2026. 6. The Respondent No.2 and 3 submits that, they have no further claims from the petitioner in any aspect in any manner. - 4 - HC-KAR NC: 2026:KHC:30591 CRL.P No. 6050 of 2026 7. The Respondent No.2 and 3 submits that, now they have decided to with draw the case filed against the petitioner before the Respondent No.1 in Crime No. 209/2017 (CC No.145/2018). 8. Both the Petitioner and Respondent No.2 and 3 hereby state and declare that the above Joint Memo has been entered into between the parties by their own free will, without any coercion, undue influence etc., The Hon'ble Court may be pleased to record the Joint Memo and pass necessary orders in view of this Memo.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Joint Memo as quoted supra being filed by the parties to the lis and offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.145/2018, pending before the 3rd Addl.
