HC-KAR NC: 2026:KHC:30590 WP No. 4928 of 2025
3. The parties to the lis during the subsistence of the proceedings have entered into a settlement and would want to terminate the proceedings on the said settlement.
4. Learned HCGP appearing for the respondent-State would however not accept the settlement to be entered into and closing of the proceedings only on the score that Section 306 of the IPC is an offence which is punishable up to 10 years.
5.
Learned counsel for the petitioner would seek to place reliance upon the judgment of the High Court of Delhi in Crl.M.C.3383/2022, disposed on 01.08.2022, wherein the Delhi High Court has accepted the settlement and terminated the proceedings thereon.
6. A perusal at the summary of the charge sheet would clearly indicate that the petitioner is a stranger to the allegation and without any rhyme or reason, has been drawn into the web of crime. In that light, even if further proceedings are permitted against the petitioner, there is no chance of him getting convicted, as the law is goaded against the prosecution.
