Heard the parties.

The grievance of the petitioner is that the amount lying with the CMPF in relation to grandfather of this petitioner-Phagu Oraon, has not been disbursed.

It is the case of the petitioner that the petitioner being the grandson, is entitled for the aforesaid amount, for which the respondent-CMPFO has sought some instructions and verification / documents from the employer i.e., Central Coalfields Limited but till date, nothing has been paid.

From the records, I find that the grandfather of this petitioner died on 20.12.2012 and it is the grievance of the petitioner that the CMPF amount has not yet been disbursed.

If the CMPF amount of Phagu Oraon has not been disbursed, the same needs to be disbursed to the legal heirs of the deceased. Thus, I direct the respondents to disburse the amount to the legal heirs of the deceased, at the earliest, as per the share

within a period of 10 weeks from the date of receipt of a copy of this order.

With the aforesaid observations, this writ petition stands disposed of.
