Heard Sri K.Satyanandam, learned counsel for the Petitioner, Sri K.Ramesh Babu, legal aid counsel for respondent No.2 and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for respondent State. Perused the material on record. Learned counsel for the Petitioner would submit that it is a matrimonial dispute between the Petitioner /A.1 and respondent No.2 who are husband and wife respectively. Petitioner is falsely implicated in the present case and he is innocent of the offence. This case is foisted with a view to settle the matrimonial disputes between the parties. Learned counsel requested to grant anticipatory bail to the Petitioner in event of his arrest. Learned Assistant Public Prosecutor would submit that there is verifiable material against the Petitioner and investigation is not yet completed and would submit that the Court may pass appropriate orders. Considering the submissions and a fair look at the material on record, as rightly put by learned Assistant Public Prosecutor, the crime is under investigation and it is not the stage to grant anticipatory bail to the petitioner. 3 Accordingly, this Criminal Petition is dismissed. However, Petitioner is at liberty to surrender before the concerned Trial Court and move a regular bail petition. On filing of such bail petition, the concerned Magistrate is directed to pass appropriate orders according to law, as expeditiously as possible. Pending applications, if any, shall stands closed.
