1. The petitioners had earlier filed WP(C) No. 1227/2026 for commanding the respondents for various reliefs including the one for restraining the respondents from dispossessing the petitioners in any manner from their proprietary land comprising Khasra Nos. 102, 103 and 383 situated at Village Khawas, Tehsil Khawas, District Rajouri. The said writ petition was disposed of after the respondents submitted that they were carrying construction/renovation activities on the land already acquired comprising Khasra No. 99, 99/1, 100 and 101 vide award dated 23.03.1995 and in case the Government required the land of the petitioners at any point of time, the same would be acquired in accordance with law. The said writ petition came to be disposed of in terms of order dated 04.05.2026 by directing the respondents not to interfere with the land of the petitioners comprising Khasra Nos. 102 measuring 06 marlas, 103 measuring 12 marlas and 383 situated measuring 07 marlas situated at Village Khawas, Tehsil Khawas and Serial No. 181

District Rajouri and further it was provided that in the event need arises for utilising the subject land or any portion thereof, the same shall be done in accordance with the provisions of the acquisition law in force.

Learned counsel for the petitioners submits that after the order (supra) was passed by the co-ordinate Bench of this Court, the respondents violated the same which prompted the petitioners to file contempt petition wherein it was stated by the respondents that they are not interfering into the possession of the petitioners’ land.

The petitioners have now come up with this petition complaining that notwithstanding the order passed by the co-ordinate Bench of this Court (supra) and the submissions made by the respondents in the contempt petition that they are still interfering with the possession of the petitioners over their proprietary land and in fact are consuming/ utilizing the land of the petitioners.

Learned counsel for the petitioners further submits that the grievance of the petitioners at this stage shall stands redressed in the event respondent No. 3- Deputy Commissioner, Rajouri constitute a committee of Senior officers to undertake the demarcation of the land of the petitioners.

7. Mr. Raman Sharma, learned Senior counsel submits that though the respondents have neither interfered nor consumed/utilized the land of the

petitioners but the respondents have no objection if the demarcation is conducted by the revenue authorities concerning the proprietary land of the petitioners.

In view of above, the present petition is disposed of by directing respondent No. 3 to constitute a commission of Senior Officers to undertake the demarcation of the land of the petitioners comprising Khasra Nos. 102, 103 and 383 situated at Village Khawas, Tehsil Khawas, District Rajouri. The entire exercise of demarcation shall be conducted within a period of 15 days from the date of receipt of this
order.
9. Needless to say that the petitioners as well as the interested parties shall be associated during the demarcation process.
