In view of these facts, the present revision is allowed and the judgment passed by learned Additional Sessions Judge, Paonta Sahib, District Sirmaur, H.P. in Criminal Appeal No. 81/2023, titled Kumbia Ram versus H.P. State Cooperative Agriculture and Rural Development Bank, Branch at Shillai, District Sirmaur, H.P., a<rming the judgment of conviction and order of sentence passed by learned Judicial Magistrate First Class, Shillai, District Sirmaur, H.P on 05.08.2023/07.08.2023, in Case No. 138 N.I. Act/9/2022, titled H.P. State Cooperative Agriculture and Rural Development Bank, Branch at Shillai, District Sirmaur, H.P. Vs. Kumbhiya Ram are ordered to be set aside. The complaint is dismissed as not pressed. 4. It is stated that no money has been deposited before any Court. Therefore, no order is required to be passed with regard to the disbursal of the amount. 5. It is stated that the petitioner is presently lodged in Model Central Jail, Nahan, District Sirmaur, H.P. He is ordered to be released forthwith, if not required in any other case. Release 3 warrants be prepared accordingly and the same be sent to the Superintendent, Model Central Jail, Nahan, District Sirmaur, H.P. through FASTER forthwith for necessary compliance. 6.
