This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 305/2025 registered at Police Station – Azad Chowk, District – Raipur (C.G.) for the offence punishable under Sections 296, 351(2), 115(2), 118(1) and 118(2) of the BNS and Sections 25 and 27 of Arms Act.

Case of the prosecution, in brief, is that Police of the Police Station concerned had received information that an a injured has been admitted in AIMS and stated that the applicant committed marpeet through hand fist and with sharp weapon hence injured at neck. As per the Dehati Nalisi on 18.10.2025 about 12.40 pm at Thakre Chowk Ramkund, the victim Bhola Nishad was standing and at the same time present accused with his friend using filthy abuses with RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 old enemy and started a fighting and stabbed with sharp weapon at neck. Thereafter, they were arrested by the Police. Hence, this application.

Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the applicant is said to have caused injuries to the injured by knife and it is stated that the injured Bhola Nishad has been examined before the trial Court and stated that on account of scuffle, he had received the said injuries. It is submitted that the applicant is in jail since 24.10.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail.

On the other hand, learned State counsel, opposes the bail application and submits that the applicant has caused injuries to the injured by knife and during the course of investigation, it was revealed that the injured has received one incise wound on neck and one cut wound on his left neck, which is appearing to be injuries caused by a sharp weapon, and also the said injuries are grievous in nature and dangerous to life. As such, the bail application deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the facts and circumstances of the case and also the fact that the applicant has caused injuries to the injured by knife and during the course of investigation, it was revealed that
3 the injured has received one incise wound on neck and one cut wound on his left neck, which is appearing to be injuries caused by a sharp weapon, and also the said injuries are grievous in nature and dangerous to life, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.

Accordingly, this bail application of applicant – Satyam Netam, involved in Crime No. 305/2025 registered at Police Station – Azad Chowk, District – Raipur (C.G.) for the offence punishable under Sections 296, 351(2), 115(2), 118(1) and 118(2) of the BNS and Sections 25 and 27 of Arms Act, is rejected at this stage.
8. Needless to say that the trial Court concerned is at liberty to proceed with the trial and conclude the same, expeditiously.
