“10.1 That this Hon'ble court may kindly be pleased to direct the respondents for deciding the representation of the petitioner and for conducting spot inspection of the subject land and once it is found that land is coming submergence then respondents may be directed to pay the compensation within stipulated time. 10.2 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner.”

Learned counsel for the petitioner submits that the petitioner is the owner of land bearing Khasra Nos. 262/3 and 286/3, admeasuring 0.0320 hectare and 0.1050 hectare respectively, situated at Village Kabaripali, Tahsil Dabhra, District Sakti (C.G.). It is further submitted that the aforesaid land has been utilized for construction of Ghatoi Dam by the Water Resources Department. Despite such utilization of the petitioner’s land, no compensation has been paid to the petitioner till date. Learned counsel further submits that the petitioner has preferred representations on various occasions before the competent authority for grant of compensation and the last representation is still pending
consideration. It is also submitted that in respect of similarly situated persons of the same village, notification under Sections 11 and 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 has already been issued, however, the petitioner has not been extended the same benefit. Therefore, it is prayed that at this stage liberty may be granted to the petitioner to file a fresh representation for redressal of his grievance and a direction be
3 issued to the respondent authorities, particularly the concerned Land Acquisition Officer / Water Resources Department, to consider and decide the same and to take appropriate steps for acquisition/compensation in accordance with law.
4. Learned State counsel submits that the present petition may be
disposed of with an appropriate direction to the competent authority to consider and decide the petitioner’s grievance in accordance with law.

Having considered the limited prayer made by learned counsel for the petitioner, and without entering into the merits of the case, this petition is disposed of granting liberty to the petitioner to file a fresh representation before the competent respondent authority along with all supporting documents and a copy of this order within a period of 15 days from today.

In the event of such representation being filed by the petitioner, the respondent authorities are directed to consider and decide the same by passing a reasoned and speaking order, strictly in accordance with law, within a further period of 45 days from the date of receipt of such representation. While considering the petitioner’s claim, the competent authority shall also examine whether the petitioner’s land bearing Khasra Nos. 262/3 and 286/3 situated at Village Kabaripali, Tahsil Dabhra, District Sakti (C.G.) has been utilized/affected for construction of Ghatoi Dam, and if it is found that the petitioner’s land has in fact been utilized
4 for the said project, appropriate proceedings for payment of compensation to the petitioner shall be undertaken in accordance with law with due expedition.
7. The aforesaid proceedings with regard to acquisition and grant of compensation be concluded within a further period of 90 days from the date of demarcation of aforesaid land of petitioner.
8. It is made clear that this Court has not expressed any opinion on the merits of the petitioner’s claim and the competent authority shall take an independent decision on the basis of the material available on record and the documents that may be furnished by the petitioner.
9. With the aforesaid observations and directions, the writ petition stands disposed of.
