Mr. Maan Singh, Advocate, for respondents No. 1 to 3. Mr. Diwakar Dev Sharma, Additional Advocate General, for respondents No. 4 and 5. OMP(M) No. 508 of 2026 The instant application has been filed under Section 5 of the Limitation Act for condonation of delay in filing the appeal. It has been stated in the application that there is a delay of 9 days in filing the instant appeal. It is averred that after the pronouncement of the judgment on 12th March, 2026, the certified copy was applied on 6th April, 2026 and delivered on 29th April, 2026. The Registry of this Court raised an objection regarding the limitation period of 9 days. The applicants were pursuing the matter diligently and the delay of 9 days was neither intentional nor deliberate, but due to unavoidable circumstances which were beyond the control of applicant. Learned counsel appearing for the respondents have no objection in case the present application is allowed. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit, and keeping in view the fact that the learned counsel for the non- applicants have no objection, the present application is allowed and the delay in filing the appeal is condoned. The application stands disposed of. Arb. Appeal No.____/2026 (Filing No. ARB.A/36210/2026) Appeal be registered. Heard. Admit. List for hearing in due course. In the meantime, record be requisitioned. OMP No. _____ of 2026 (OMPST No. 34738/2026) Be registered. Subject to deposit of entire awarded amount alongwith up-to-date interest by the applicant/appellant, execution, implementation and operation of impugned award dated 05.09.2024, passed by learned Arbitrator and judgment dated 12.03.2026, passed by learned District Judge, Mandi, H.P. in CIS Registration No. 149 of 2025, shall remain stayed during the pendency of appeal.
