JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused No.1 is before this Court calling in question proceedings in C.C.No.72622/2025, pending before the XI Additional Chief Judicial Magistrate Court, Bengaluru, for the offences punishable under Sections 85, 351(2), 352 r/w. 3(5) of the BNS. 2. Learned counsel for the petitioner and respondent No.2 in unison submit that during the pendency of the subject proceedings, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and - 3 - HC-KAR NC: 2026:KHC:31653 CRL.P No. 8237 of 2026 conditions. They have parted their ways by executing a Khulanama. The parties have filed a joint affidavit before this Court seeking permission to compound the offences. 3. The joint affidavit reads as follows: “xxxxx 1. We state that we are aware of the above facts and circumstances, hence deposing hereunder. 2. We state that the above matter have been settled amicably between the parties, which was initiated by elders, relatives, friends and well-wisher and resolved the dispute outside the court. 3. The complainant has received all her belongings on 23/06/26 from the petitioner matrimonial home. 4. The complainant and petitioner have executed the Khulanamma in the above case on 24/06/26, as per Muslim sharia law before the Notary Public Karnataka, Bengaluru. 5. The respondent No.2 states that she undertakes to withdraw the case filed against the above petitioner. 6. We undertake that we shall not file any other types of criminal, civil cases against each other in whatsoever manner. 7. We have No Objection to allow the above criminal petition before this Hon'ble Court and request this Hon'ble court to quash the above Charge sheet Lodge by the Complainant. Under these circumstances it is just and necessary to allow the accompanying Joint Affidavit.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it - 4 - HC-KAR NC: 2026:KHC:31653 CRL.P No. 8237 of 2026 appropriate to accept the application and terminate the proceedings against the petitioners, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.72622/2025, pending before the XI Additional Chief Judicial Magistrate Court, Bengaluru, stand quashed. I.A.No.1/2026 also stands disposed, as a consequence.
